# STUDENT ENROLLMENT AGREEMENT, TERMS OF USE & COMPREHENSIVE LEGAL DISCLAIMERS Last Updated: September 2026 Governing Jurisdiction: Faridabad, Haryana, India Please read this Student Enrollment Agreement, Terms of Use, and Comprehensive Legal Disclaimers ("Agreement") carefully before enrolling in, purchasing, accessing, or participating in any courses, workshops, live masterclasses, distance attunements, coaching, webinars, audio tracks, digital guides, community groups, or training materials (collectively, "Programs") provided by Devi Singh’s Healing Academy ("Academy", "we", "us", "our") through its learning portal, Tutor LMS platform, mobile applications, or associated digital channels. By clicking "I Agree," checking the mandatory consent box at registration or checkout, completing payment, or logging into our platform, you ("Student", "User", "You") enter into an enforceable legal contract under the Indian Contract Act, 1872, and Section 10A of the Information Technology Act, 2000, unconditionally accepting all terms set forth below. --- ### 1. Age, Legal Capacity & Electronic Signature Validity * **Age Affirmation:** You expressly warrant and represent that you are at least eighteen (18) years of age, mentally sound, and legally competent to enter into a binding contract under Indian law. Minors (under 18) are strictly prohibited from enrolling unless registered through the express, notarized written consent of a parent or legal guardian. * **Binding Electronic Assent:** In accordance with the Information Technology Act, 2000, checking the box or completing the checkout flow serves as your valid, legally binding electronic signature, carrying the exact same evidentiary and legal weight as a handwritten physical signature. --- ### 2. Medical, Psychiatric & Non-Clinical Healing Disclaimers (Zero Clinical Liability) * **Educational & Spiritual Scope Only:** All training, coursework, self-healing protocols, traditional Usui Reiki teachings, subconscious exploration, bio-energetic dynamics, and conversational hypnotherapy methods are offered solely for educational, spiritual, meditative, and self-improvement purposes. They do NOT constitute, replace, or substitute for formal medical advice, clinical diagnosis, licensed psychotherapy, psychiatric evaluation, surgical intervention, or prescription medications. * **No Medical Claims:** Devi Singh’s Healing Academy and Master Devi Singh do not claim to diagnose, cure, treat, reverse, or prevent any clinical illness, physiological pathology, psychiatric illness, or chronic medical condition. * **Severe Psychiatric & Neurological Contraindications:** Our deep meditative routines, subconscious regression exercises, and hypnotic processes are strictly contraindicated for individuals suffering from diagnosed or unmanaged severe psychiatric disorders (including, without limitation: schizophrenia, clinical psychosis, bipolar disorder, severe dissociative disorders, borderline personality disorders, or unmanaged epileptic conditions). If you have a history of such conditions, you must refrain from enrolling unless explicitly cleared in writing by a licensed medical psychiatrist. * **Continuance of Allopathic / Medical Regimens:** You must never suspend, delay, modify, or discontinue any prescribed medications, medical appointments, or conventional clinical treatments without the direct supervision of your licensed physician. * **No Emergency Crisis Services:** The Academy does not provide crisis intervention, suicide prevention, or emergency medical services. In the event of a medical, mental, or physical emergency, immediately contact your local emergency healthcare providers or a licensed hospital. --- ### 3. Energetic Attunement, Detoxification & "Healing Crisis" Waiver * **Subtle Energy Processing:** Students explicitly acknowledge that subtle energy attunements, chakra balancing, aura cleansing drills, and energetic shifts can sometimes initiate emotional, psychological, or physical detoxification processes (frequently recognized in holistic traditions as a "21-Day Cleansing Period" or "Healing Crisis"). * **Sensory Manifestations:** These normal energetic adjustments may include emotional releases, crying, fatigue, vivid dreams, mild headaches, digestive variations, or transient mood shifts. * **Voluntary Assumption of Risk:** You voluntarily assume all risks for your personal experience, sensations, and emotional responses during and following any attunement, releasing the Academy from any claims of harm, emotional distress, or physiological discomfort resulting from such natural energetic adjustments. --- ### 4. Certification Scope & Independent Practitioner Ethical Limits * **Non-Medical Certification:** Successful completion of any course or the awarding of a Practitioner/Master Certificate from Devi Singh’s Healing Academy confirms only that you have met our internal educational and attunement requirements within non-clinical holistic modalities. * **No Professional Medical Title:** Certification does NOT confer the right to use protected medical or legal titles, including "Doctor", "Dr.", "Licensed Clinical Hypnotherapist", "Psychologist", or "Registered Medical Practitioner", nor does it grant clinical diagnostic or prescription privileges under Indian Medical Council regulations or any international regulatory body. * **Sole Third-Party Liability:** If you conduct sessions or offer services to third-party clients, you do so entirely at your own independent legal, ethical, and financial risk. The Academy, Master Devi Singh, and its affiliates carry zero legal, ethical, or financial liability for sessions, claims, disputes, injuries, or outcomes between you and your clients. --- ### 5. Comprehensive Indemnification Clause * You agree to defend, indemnify, and hold harmless Devi Singh’s Healing Academy, Master Devi Singh, its instructors, contractors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees and court costs) that arise from: 1. Your violation of this Agreement. 2. Your unauthorized application, misuse, or negligent practice of any techniques learned through the Academy on third parties. 3. Any injury, dispute, or claim brought against the Academy by any third party as a result of your private practice or statements. --- ### 6. Intellectual Property, Anti-Piracy & Anti-Compete Protection * **Proprietary Ownership:** All curriculum outlines, high-resolution training videos, downloadable audio meditations, Hindi and English eBooks, training manuals, sacred symbol illustrations, slide decks, and proprietary attunement processes are the exclusive intellectual property of Devi Singh’s Healing Academy, protected under the Indian Copyright Act, 1957, and international copyright conventions. * **Single-User Personal License:** Enrollment grants you a single, non-transferable, revocable, non-exclusive license for personal educational study only. * **Strict Anti-Piracy Mandate:** You are strictly prohibited from: 1. Screen recording, audio ripping, scraping, or duplicating course content through software or external cameras. 2. Sharing your Tutor LMS username, password, or direct access links with third parties. 3. Distributing, publishing, uploading, or reselling Academy materials in full or in part on WhatsApp, Telegram, YouTube, social media, torrents, or file-sharing websites. 4. Teaching, publishing, or commercially exploiting our proprietary curriculum materials without formal written authorization. * **Non-Compete on Proprietary Material:** Students are strictly prohibited from copying, white-labeling, or repackaging the Academy's course structure, proprietary manuals, or custom materials to launch directly competing commercial certifications using our exact instructional blueprints. * **Legal Consequences:** Any unauthorized redistribution or violation of intellectual property will cause immediate and permanent termination of platform access without notice or refund, alongside immediate initiation of statutory civil damages and criminal prosecution under Sections 51, 63, and 64 of the Indian Copyright Act, 1957. --- ### 7. Strict No-Refund Policy & Chargeback Waiver * **Finality of Purchase:** Due to the irreversible delivery of proprietary digital intellectual property, immediate server bandwidth allocation, instant delivery of access credentials, and scheduled distance attunement slots, all fees paid for courses, workshops, private consultations, and digital products are 100% NON-REFUNDABLE, NON-TRANSFERABLE, and NON-EXCHANGEABLE. * **No Exceptions:** No full or partial refunds will be granted for any reason, including but not limited to: personal scheduling conflicts, change of mind, failure to complete course modules, technical or hardware deficiencies on the student's end (such as weak internet connection or outdated web browsers), or lack of personal resonance with course topics. * **Prohibition of Chargebacks:** You unconditionally waive any right to file fraudulent chargebacks, payment cancellations, or false claims of "unauthorized transaction" or "services not received" through your credit card provider, issuing bank, or payment processing intermediary (Razorpay, Stripe, PayPal, or UPI service providers). In the event of an unjustified chargeback attempt, the Academy reserves the right to recover full administrative and legal fees, cancel access immediately, and submit default records to credit reporting institutions. --- ### 8. Platform Access, Course Validity & System Downtime * **Definition of "Lifetime Access":** Where course access is marketed as "Lifetime Access", it legally refers to the lifetime of the course as hosted on our current learning management system (Tutor LMS) and while the product is actively maintained by the Academy. The Academy reserves the right to update, revise, migrate, or discontinue legacy courses upon providing reasonable notice. * **Access Revocation on Inactivity or Abuse:** The Academy reserves the right to archive or suspend access for accounts demonstrating suspicious multi-IP login activity indicative of credential sharing. * **System Maintenance:** Temporary service interruptions for server upgrades, maintenance, or technical hosting issues do not constitute a breach of contract or entitle the student to financial compensation. --- ### 9. Interactive Live Classes, Privacy & Media Recording Consent * **Archival Recording:** Live sessions hosted on Zoom, Google Meet, or within the Tutor LMS framework may be recorded and retained within student portals for educational review, replays, and curriculum enhancement. * **Consent to Media Use:** By participating in live batches with your camera, microphone, or chat box enabled, you grant the Academy an irrevocable, royalty-free, perpetual license to include your voice, image, comments, and interactions in recorded archives and educational replays made available to other enrolled students. * **Confidentiality of Peers:** You agree to maintain strict confidentiality regarding any personal stories, emotional breakthroughs, or private disclosures shared by fellow students during live workshops or community discussions. --- ### 10. Data Protection & Privacy Compliance (DPDP Act) * The Academy collects and processes personal information (such as name, email, phone number, and transaction logs) strictly for account provisioning, LMS authentication, certificate issuance, and educational communication in accordance with Indian data protection laws. * We implement standard security measures to safeguard your personal data and do not sell or rent personal information to unauthorized third parties. --- ### 11. Student Code of Conduct, Anti-Defamation & Instant Termination * **Zero Tolerance for Disruption:** The Academy maintains an uncompromising standard of mutual respect, ethics, and psychological safety. Rude, defamatory, derogatory, or abusive behavior toward instructors, administrators, or fellow students will result in immediate ban without refund. * **Commercial Solicitation Ban:** Unauthorized commercial solicitation, spamming, self-promotion, or recruiting fellow students into third-party business schemes or direct selling within Academy forums is strictly prohibited. * **Non-Disparagement & Anti-Defamation Covenant:** You agree not to publish, post, broadcast, or disseminate any derogatory, malicious, or defamatory remarks, reviews, or videos regarding the Academy, Master Devi Singh, or its programs across public forums, review sites, or social media channels without first completing the mandatory 30-day internal dispute resolution process. --- ### 12. Relationship of Parties (No Partnership or Agency) * Nothing contained in this Agreement or your participation in our programs shall be construed as creating an agency, partnership, joint venture, employer-employee, or franchise relationship between you and Devi Singh’s Healing Academy. You act strictly as an independent student/practitioner. --- ### 13. Pre-Litigation Mediation & Binding Arbitration * **Mandatory Amicable Negotiation:** Prior to initiating any legal proceedings, the parties agree to engage in good-faith negotiations to resolve any dispute within thirty (30) days of formal written notice. * **Arbitration:** If unresolved through negotiation, any dispute arising out of or related to this Agreement shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by the Academy. The seat and venue of arbitration shall be **Faridabad, Haryana, India**, and proceedings shall be in English or Hindi. --- ### 14. Governing Law, Exclusive Jurisdiction & Severability * **Applicable Law:** This Agreement shall be governed exclusively by the laws of the Republic of India. * **Exclusive Court Jurisdiction:** Subject to the arbitration clause above, any legal action, suit, or proceeding shall be instituted exclusively in the competent courts situated in **Faridabad, Haryana, India**. * **Severability:** If any provision of this Agreement is held to be invalid, unlawful, or unenforceable, such provision shall be severed, and the remaining provisions shall continue in full force and effect. --- ### MANDATORY CHECKBOX CONSENT (For Tutor LMS Registration / Checkout) `[ x ]` I confirm that I am at least 18 years of age, am of sound mind, and have thoroughly read, understood, and voluntarily accepted this **Student Agreement, Terms of Use, Strict No-Refund Policy, and Non-Medical Spiritual Training Disclaimer**.
